Terms of Use
These terms explain the rules that apply when browsing this website, using its content, and submitting renovation or restoration inquiries through Bergen Restoration.
These Terms of Use ("Terms") govern use of the Bergen Restoration website and website-originated inquiry features. They explain the conditions that apply when you browse the site, use its content, submit an inquiry, upload project information, or communicate with Bergen Restoration through a website-provided channel.
These Terms are not a home-improvement contract and do not by themselves authorize construction, renovation, restoration, repair, demolition, or other project work. Actual project work is subject to a separate written agreement where required by applicable law.
1. About Bergen Restoration and the Website
The website is provided for Bergen Restoration LLC, a New Jersey home improvement contractor business serving residential customers in Bergen County and surrounding areas as applicable.
Bergen Restoration LLC — 275 Engle St, Englewood, NJ 07631 — Phone: (862) 420-0509 — Email: hi@bergenrestoration.com — New Jersey Home Improvement Contractor Business Registration: NJHIC# 13VH08865500
The website is managed by OnMap Media LLC on behalf of Bergen Restoration. OnMap Media may provide hosting, maintenance, security, analytics, attribution, lead routing, website administration, marketing operations, and related technical support. OnMap Media is not the contractor providing renovation, restoration, or home-improvement work merely because it manages or supports the website.
For provisions that relate specifically to website operation, the "Website Parties" means Bergen Restoration LLC and OnMap Media LLC, together with their respective personnel and service providers acting within the scope of website operation.
2. Scope and Acceptance of These Terms
These Terms provide the conditions governing use of the website and its website-originated features.
Some provisions function as notices concerning the website regardless of whether a separate contract is formed. Provisions that require contractual assent apply only to the extent you have validly agreed to them or they are otherwise enforceable under applicable law.
If a page, form, or other interface clearly states that completing an action constitutes agreement to these Terms, completing that action constitutes acceptance to the extent permitted by law.
If you do not agree to Terms presented for affirmative acceptance, do not complete the action requiring that acceptance.
Nothing in these Terms replaces or waives any non-waivable right or protection provided by applicable consumer law.
3. Website Information Only; No Project Agreement
The website provides general information about Bergen Restoration, its services, service areas, project considerations, and ways to contact the company.
Browsing the website, calling a listed number, sending a message, submitting a project inquiry, requesting an estimate, uploading project information, or receiving preliminary information does not by itself:
- create a contractor-client relationship;
- form a home-improvement contract;
- authorize Bergen Restoration to begin work;
- guarantee that Bergen Restoration will accept a project;
- guarantee availability, scheduling, pricing, materials, permits, or completion dates;
- create a warranty or guarantee regarding a proposed project; or
- replace documents required by New Jersey law or other applicable law.
A project becomes binding only through the written agreement, acceptance, authorization, or other contract process applicable to that project and permitted by law.
4. New Jersey Home-Improvement Projects
For New Jersey home-improvement work, Bergen Restoration handles actual project agreements separately from this website.
Where New Jersey law requires a home-improvement contract, change order, notice, or other project document to be in writing, Bergen Restoration will use separate project documents intended to contain the information, signatures, cancellation rights, notices, and other terms required by applicable law.
Website content, inquiry forms, calls, messages, emails, preliminary scopes, estimates, and uploads do not substitute for required project documents.
If a website statement conflicts with a valid, signed project agreement, the signed project agreement governs the project to the extent permitted by law.
Nothing in these Terms limits a New Jersey consumer right that cannot lawfully be waived or limited.
5. Estimates, Consultations, and Project Information
Bergen Restoration may choose to provide a written estimate, preliminary scope, consultation, site visit, or other project assessment after reviewing an inquiry.
Any estimate or preliminary project information is based on the information reasonably available at the time and may be affected by concealed conditions, code requirements, engineering or design needs, material availability, site access, measurements, permits, inspections, utility requirements, specialty-trade requirements, or changes requested by the property owner.
Unless a separate written agreement expressly states otherwise:
- an estimate is not authorization to begin work;
- an estimate does not itself create a home-improvement contract;
- website pricing examples, ranges, timelines, and budget discussions are illustrative only;
- project availability is not guaranteed; and
- a proposal may be revised or withdrawn before a binding project agreement is formed, subject to applicable law.
If a site visit, diagnostic service, specialized inspection, travel charge, testing service, engineering review, or other assessment requires a fee, Bergen Restoration will disclose the fee before it is charged and obtain any agreement required by law.
6. Local Codes, Permits, Inspections, Utilities, and Specialty Trades
Website information about building codes, permits, inspections, zoning, utilities, licensing, project sequencing, costs, or timelines is general information only.
Requirements can differ by municipality, property, project type, existing conditions, scope of work, utility provider, and changes in law or enforcement practices. A page referring to a particular Bergen County municipality does not guarantee that a stated permit, inspection, code, zoning, utility, licensing, or scheduling requirement applies to your property.
Some project components may require work by, coordination with, or approval from separately licensed or regulated professionals, trades, engineers, architects, utilities, inspectors, or government authorities.
Project-specific requirements will be addressed through the applicable project process rather than through general website content.
7. Emergency and Urgent Conditions
The website may describe emergency intake or urgent restoration services. Availability of an intake channel does not guarantee immediate dispatch, arrival, remediation, or restoration service.
Do not rely on a website form, email, WhatsApp message, or other non-emergency website channel for an immediate threat to life, safety, or property.
If there is an active fire, suspected gas leak, electrical hazard, structural-collapse risk, medical emergency, or other immediate danger, contact 911, the fire department, the relevant utility, or another appropriate emergency authority before contacting Bergen Restoration.
For urgent property-damage inquiries, call (862) 420-0509. Response times depend on circumstances, location, staffing, site safety, weather, call volume, access, and other conditions.
8. Project Inquiries, Uploaded Materials, and Information You Provide
When you submit a project inquiry or provide materials through a website-originated channel, you represent that the information is accurate to the best of your knowledge and that you are authorized to provide it.
Do not submit:
- intentionally false or misleading information;
- content you do not have the right to provide;
- unlawful, threatening, abusive, infringing, or malicious content;
- passwords, Social Security numbers, financial-account credentials, full payment-card information, medical records, or other unnecessary highly sensitive information; or
- malware, malicious code, or files intended to disrupt, damage, or compromise systems.
You are responsible for ensuring that you have authority to request contact concerning the property, telephone number, email address, photographs, documents, and other information you provide.
Limited license for submitted materials
You retain any ownership rights you have in photographs, documents, descriptions, plans, files, or other materials you submit.
By submitting those materials to Bergen Restoration through a website-originated channel, you grant Bergen Restoration and, where reasonably necessary for website or inquiry administration, OnMap Media and applicable service providers a limited, non-exclusive license to receive, copy, store, transmit, review, process, and internally use the materials only as reasonably necessary to:
- evaluate or respond to your inquiry;
- communicate with you;
- prepare or discuss an estimate or proposed scope;
- schedule or administer requested services;
- maintain appropriate business, security, and legal records; or
- perform another purpose you request or authorize.
This limited license does not authorize Bergen Restoration or OnMap Media to use your submitted project materials in public advertising, portfolios, social media, case studies, or unrelated marketing without any additional permission required by law or by the circumstances.
9. Phone, Email, WhatsApp, and Other Communications
If you provide contact information and request or permit follow-up, Bergen Restoration may contact you through channels reasonably associated with your inquiry, including phone, email, WhatsApp, or another communication channel you request or use, subject to applicable law.
Communications may concern:
- a project inquiry you submitted;
- questions needed to evaluate the requested work;
- appointment or consultation scheduling;
- estimate preparation or delivery;
- project coordination or status;
- service follow-up; or
- other communications reasonably related to your request or existing project relationship.
Submitting an inquiry does not authorize unrelated promotional communications where separate consent or another legal basis is required.
10. WhatsApp and Other Third-Party Communication Services
The website may provide links that allow you to contact Bergen Restoration through WhatsApp or another third-party communication platform.
When you use one of those services, the platform provider may process your information under its own terms and privacy practices. Bergen Restoration does not control the platform's independent systems, availability, security, or policies.
A message sent through a third-party platform does not by itself form a project contract or authorize work.
11. Website Content and Accuracy
We try to keep website information useful and reasonably current, but construction, renovation, restoration, permitting, products, pricing, availability, and local requirements can change.
Website content may contain errors, omissions, outdated information, or generalizations that do not apply to a particular property, and we may update or remove it at any time.
Photographs, renderings, diagrams, icons, illustrations, before-and-after examples, descriptions, and project examples are informational or illustrative unless expressly identified otherwise. They do not guarantee that another project will have the same scope, appearance, price, schedule, materials, or result.
12. No Professional Advice
Website content is not legal, engineering, architectural, environmental, insurance, financial, medical, or other regulated professional advice.
Where a project requires advice, design, testing, certification, or approval from a licensed or qualified professional, the appropriate professional should evaluate the actual property and scope.
13. DIY, How-To, and Educational Content
The website may contain articles, comparisons, maintenance or troubleshooting information, project explanations, checklists, "DIY vs. professional" discussions, and other educational content relating to renovation, restoration, repair, and maintenance.
This content is provided for general informational purposes only. It is not project-specific instruction and is not a substitute for an on-site inspection, professional advice, manufacturer instructions, permits, code review, utility requirements, safety procedures, or qualified professional services where required.
The Website Parties do not supervise, direct, control, or assume responsibility for work that a visitor independently chooses to perform based on website content.
Home-improvement, repair, maintenance, troubleshooting, and restoration activities can involve serious risks, including personal injury or death; electrical shock, fire, flooding, structural damage, hazardous-material exposure, gas or combustion hazards, damage to property or building systems, voided warranties, adverse insurance consequences, code or permit violations, fines, penalties, required rework, and other losses not apparent from general website content.
Conditions vary substantially between properties. Information that may be safe, lawful, or appropriate in one situation may be unsafe, unlawful, incomplete, or inappropriate in another.
Before performing work yourself, you are responsible for determining whether the work may lawfully be performed by a property owner, whether permits, inspections, licensed or qualified professionals, utility coordination, manufacturer procedures, protective equipment, testing, containment, shutoff procedures, or other precautions are required, and whether you have the knowledge, tools, training, equipment, and experience necessary to perform the work safely.
Do not perform work that you are not qualified, equipped, or legally permitted to perform. Do not rely solely on website content to perform work involving energized electrical equipment, gas systems, structural components, hazardous materials, significant contamination, active fire or flooding hazards, or other conditions capable of causing serious injury, death, or substantial property damage.
To the fullest extent permitted by applicable law, the Website Parties are not responsible for consequences arising from a visitor's independent DIY actions, including injury, property damage, code or permit violations, fines, penalties, or other losses, where those consequences result from site conditions, the visitor's acts or omissions, failure to obtain required professional assistance or approvals, or use of general website information as project-specific instructions. This provision does not exclude or limit responsibility for the Website Parties' own conduct where applicable law does not permit that responsibility to be excluded or limited.
Nothing in this section limits any liability, duty, remedy, or consumer right that cannot lawfully be limited or waived.
14. Intellectual Property
The website and its original content, including text, branding, design elements, graphics, photographs, videos, layouts, code, and other materials, are owned by Bergen Restoration, OnMap Media, or their respective licensors, as applicable, and are protected by applicable intellectual-property laws.
You may view, print, or save reasonable portions of the website for your own non-commercial use in evaluating Bergen Restoration's services.
Unless you have prior written permission from the applicable rights holder, you may not:
- reproduce or republish substantial portions of the website for commercial use;
- sell, license, or commercially exploit website content;
- remove ownership, copyright, trademark, or attribution notices;
- use website content to impersonate Bergen Restoration or OnMap Media;
- use automated means to scrape or extract the site at a volume that interferes with website operation; or
- copy protected designs, photographs, text, or other original materials in violation of applicable law.
Nothing in these Terms transfers ownership of an intellectual-property right to you.
15. Permitted Use and Prohibited Conduct
You may use the website for lawful informational and project-inquiry purposes.
You may not:
- interfere with or disrupt website operation;
- attempt unauthorized access to any server, account, form endpoint, database, or administrative system;
- probe, scan, or test security controls without authorization;
- introduce malware, malicious code, automated spam, or harmful payloads;
- use the website to violate law or another person's rights;
- submit fraudulent or deceptive inquiries;
- overload website infrastructure through abusive automated requests; or
- circumvent access controls or security measures.
We may restrict or block access when reasonably necessary to protect the website, users, systems, or service providers.
16. Third-Party Links, Tools, and Embedded Services
The website may link to or use services provided by third parties, including maps, analytics and session-replay providers, advertising and attribution platforms such as Meta Business Tools, search-performance tools such as Google Search Console, fonts, communications platforms, review services, social platforms, media hosts, and other external resources.
A link or integration does not necessarily mean Bergen Restoration endorses every statement, product, policy, or practice of the third party.
The Website Parties do not control third-party services and are not responsible for their independent content, availability, security, terms, or privacy practices. Your use of a third-party service is subject to that provider's applicable terms.
17. Analytics, Advertising, and Search-Performance Tools
The website may use third-party tools for analytics, session replay, advertising measurement, attribution, audience-related functions, and search-performance monitoring, including Microsoft Clarity, Meta Business Tools such as the Meta Pixel, and Google Search Console.
These tools may be operated by third parties under their own terms and privacy practices. Their use on the website is described in more detail in our Privacy Policy.
18. Website Availability
We may modify, suspend, restrict, or discontinue all or part of the website at any time. We do not guarantee uninterrupted, error-free, secure, or continuously available access.
Maintenance, outages, security events, third-party service failures, network conditions, or other events may temporarily affect website availability.
19. Website Disclaimer
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND WEBSITE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
The Website Parties do not make warranties regarding uninterrupted availability, error-free operation, completeness, accuracy, suitability for a specific property, or freedom from every security risk.
To the fullest extent permitted by law, the Website Parties disclaim implied warranties relating solely to use of the website, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
This website disclaimer does not replace, disclaim, or modify warranties, obligations, or remedies that apply to actual home-improvement work under a separate project agreement or applicable law.
General website content is not a representation that a visitor can safely or lawfully perform a particular repair, renovation, restoration, maintenance, troubleshooting, or other task without professional evaluation. Independent DIY activity is also subject to Section 13, DIY, How-To, and Educational Content.
20. Limitation of Liability for Website Use
To the fullest extent permitted by applicable law, the Website Parties will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, inability to use, or reliance on the website or third-party website services.
This section does not limit liability to the extent a limitation is prohibited by applicable law. Nothing in these Terms is intended to exclude or limit a liability, remedy, consumer protection, statutory right, or other obligation that cannot lawfully be excluded or limited.
For clarity, this section concerns the website and website-originated services, including reliance on general educational or DIY-related website content. Rights and responsibilities relating to actual project work performed by Bergen Restoration are governed by the applicable project agreement and law.
21. New Jersey Consumer Rights
New Jersey residents may have rights and remedies that cannot be waived or limited by online terms.
Any disclaimer, limitation, venue provision, or other term in these Terms applies only to the extent enforceable under New Jersey law and other applicable law. If a provision would unlawfully waive a non-waivable consumer right, that provision will not be applied to that extent.
Nothing in these Terms is intended to limit rights under applicable New Jersey home-improvement, consumer-protection, contract, privacy, or other laws where those rights cannot lawfully be waived.
22. Privacy
Our collection and use of personal information through the website is described in our Privacy Policy.
The Privacy Policy is a notice about data practices. It does not itself create a home-improvement contract.
23. Changes to These Terms
We may update these Terms when website features, communications practices, services, technologies, or legal requirements change.
The Last updated date at the top identifies the most recent revision. Revised Terms apply prospectively from the date they are posted unless a different effective date is stated.
Where applicable law requires additional notice or affirmative agreement to a material change, we will provide that notice or obtain that agreement as required.
Changes to these website Terms do not modify an already executed project contract. A change to a project contract must be made through the amendment or change-order process applicable to that contract and required by law.
24. Governing Law and Forum
These Terms and website use are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent another law must apply as a matter of non-waivable law.
Where you have validly agreed to a forum-selection provision in these Terms and that provision is enforceable, disputes arising specifically from these Terms or website use will be brought in the state courts located in Bergen County, New Jersey, or the United States District Court for the District of New Jersey, as applicable.
This section does not deprive a consumer of a forum, venue, or procedural right that cannot lawfully be waived.
25. Severability
If a court of competent jurisdiction determines that a provision of these Terms is invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted by law or, where appropriate, limited so that it becomes enforceable. The remaining provisions will remain in effect to the extent permitted by law.
26. No Waiver
A failure to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision or another provision later.
27. Accessibility
Bergen Restoration is committed to making its website reasonably accessible to visitors, including people who use assistive technologies.
If you encounter an accessibility barrier or need information from this website in another format, call (862) 420-0509 or email hi@bergenrestoration.com. We will work to provide reasonable assistance.
