The website is managed by OnMap Media LLC on behalf of Bergen Restoration. OnMap Media may provide hosting, maintenance, security, analytics, attribution, lead routing, website administration, marketing operations, and related technical support. OnMap Media is not the contractor providing renovation, restoration, or home-improvement work merely because it manages or supports the website.

For provisions that relate specifically to website operation, the "Website Parties" means Bergen Restoration LLC and OnMap Media LLC, together with their respective personnel and service providers acting within the scope of website operation.

2. Scope and Acceptance of These Terms

These Terms provide the conditions governing use of the website and its website-originated features.

Some provisions function as notices concerning the website regardless of whether a separate contract is formed. Provisions that require contractual assent apply only to the extent you have validly agreed to them or they are otherwise enforceable under applicable law.

3. Website Information Only; No Project Agreement

The website provides general information about Bergen Restoration, its services, service areas, project considerations, and ways to contact the company.

Browsing the website, calling a listed number, sending a message, submitting a project inquiry, requesting an estimate, uploading project information, or receiving preliminary information does not by itself:

• create a contractor-client relationship;

4. New Jersey Home-Improvement Projects

For New Jersey home-improvement work, Bergen Restoration handles actual project agreements separately from this website.

Where New Jersey law requires a home-improvement contract, change order, notice, or other project document to be in writing, Bergen Restoration will use separate project documents intended to contain the information, signatures, cancellation rights, notices, and other terms required by applicable law.

Website content, inquiry forms, calls, messages, emails, preliminary scopes, estimates, and uploads do not substitute for required project documents.

If a website statement conflicts with a valid, signed project agreement, the signed project agreement governs the project to the extent permitted by law.

Nothing in these Terms limits a New Jersey consumer right that cannot lawfully be waived or limited.

• a proposal may be revised or withdrawn before a binding project agreement is formed, subject to applicable law.

If a site visit, diagnostic service, specialized inspection, travel charge, testing service, engineering review, or other assessment requires a fee, Bergen Restoration will disclose the fee before it is charged and obtain any agreement required by law.

6. Local Codes, Permits, Inspections, Utilities, and Specialty Trades

7. Emergency and Urgent Conditions

10. WhatsApp and Other Third-Party Communication Services

21. New Jersey Consumer Rights

New Jersey residents may have rights and remedies that cannot be waived or limited by online terms.

24. Governing Law and Forum

These Terms and website use are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent another law must apply as a matter of non-waivable law.

Where you have validly agreed to a forum-selection provision in these Terms and that provision is enforceable, disputes arising specifically from these Terms or website use will be brought in the state courts located in Bergen County, New Jersey, or the United States District Court for the District of New Jersey, as applicable.

This section does not deprive a consumer of a forum, venue, or procedural right that cannot lawfully be waived.

25. Severability

If a court of competent jurisdiction determines that a provision of these Terms is invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted by law or, where appropriate, limited so that it becomes enforceable. The remaining provisions will remain in effect to the extent permitted by law.

26. No Waiver
